Judge Denies Menard Suit; Stewart Free For 500
Tony Stewart has already scored his biggest victory in this year’s Indianapolis 500, and it came in a courtroom in April, not on the race track in May. A judge in Eau Claire, Wis., denied a motion by Pep Boys Indy Racing League team owner John Menard for an injuction that would have prohibited Stewart from competing in the 83rd Indianapolis 500.
Last week, a temporary restraining order issued by Eau Claire County Court Judge Eric Wahl prohibited Stewart from testing, practicing or qualifying or racing for any Team Menard competitors in the May 30 Indy 500.
Eau Claire County Judge Greg Peterson said the contract between Menard and Stewart was not clear enough to make Stewart race for Menard in the 1999 Indy 500.
